Terms of Service

1. Who we are

Bi Kai operates Metrix.Bar and metrix.bar ("we", "us"). These Terms govern your use of the Metrix.Bar app and website (the "Service"). By using the Service, you agree to these Terms and our Privacy Policy.

2. The Service

Metrix.Bar is desktop software that shows dashboards in your menu bar or system tray. Metrix.Bar Plus subscriptions are sold through agili.app; terms governing your account and payments are at agili.app/terms. The Service is delivered digitally.

3. Accounts and eligibility

You must be at least 18 years old to subscribe to Plus. Free requires no account. Keep credentials secure and report suspected unauthorized access to metrix.bar@agili.app. You are responsible for activity under your account.

4. Plans and pricing

Free is $0 with up to 3 dashboards enabled at once. Plus is US$4.99 per month for unlimited dashboards, sidebars, global shortcuts, and up to 3 activated devices. See the pricing page for details. Taxes may apply; checkout shows the final amount.

5. Automatic renewal and billing

Plus includes a 7-day free trial. If you do not cancel before it ends, your subscription renews automatically each month at US$4.99, authorizing recurring charges to your payment method. Payments are processed by Waffo Pancake or Creem as Merchant of Record; their name may appear on your statements and receipts. We never receive full card numbers. We email you at least 14 days before a price change, which takes effect at your next renewal.

6. Cancellation

You can cancel anytime in your account, inside the app, or by emailing metrix.bar@agili.app. Canceling during the trial incurs no charge. After payment, Plus stays active until your paid period ends. Your app then reverts to Free and dashboards remain on your device.

7. Refunds and billing questions

To request a refund, email metrix.bar@agili.app. Refunds return to your original payment method.

• Initial purchase: Full refund if requested within 14 days.
• Renewals: Non-refundable, except for billing errors or mandatory statutory rights (such as EU/UK withdrawal rights).
• Errors: Duplicate or incorrect charges are always refunded.
• Disputes: Contact metrix.bar@agili.app before disputing a charge; we reply within 2 business days and correct errors within 5 business days.

8. Acceptable use and dashboards

Use the Service lawfully. Do not attack systems, bypass plan or device limits, or resell the Service. Dashboards run locally, and credentials stay in your system credential store. Third-party dashboards and APIs you connect are governed by their own terms.

9. Intellectual property, disclaimers, and liability

We own the Service and grant you a limited, revocable license to use it. Content and dashboards you create remain yours.

The Service is provided "as is" without warranties. To the extent permitted by law, we are not liable for indirect damages, and our total liability is capped at the amount you paid us in the preceding 12 months.

10. Suspension, governing law, and changes

We may suspend accounts for material breach or fraud. You may stop using the Service anytime.

These Terms are governed by the laws of the operator's place of residence, preserving mandatory local consumer protections. We will give at least 14 days' notice for material changes. Questions: metrix.bar@agili.app.
